Todd Gardenhire is not yet ready to claim victory in the District 10 state Senate race, but an extra 25 votes added to his tally because of "human error" in Hamilton County's Eastdale precinct put him 40 votes over opponent Greg Vital.

An audit process conducted by the Hamilton County Election Commission Friday morning revealed that none of Gardenhire's votes in Eastdale were counted on election night.

Election Commission Chairman Mike Walden said he was confident the election had been "fair and accurate."

Gardenhire is waiting on more information about the provisional ballots in Hamilton and Bradley counties before declaring victory.

Gardenhire's lead over Vital is greater than the total number of provisional ballots. Barring a vote counting anomaly in Bradley County, Gardenhire appears to be the winner.
